What the 2026 E-Commerce Amendment Rules change for search rankings and discount claims

E-commerce platforms must overhaul search algorithms, baseline discount claims against 30-day prior pricing, and publish annual dark-pattern audit certificates by January 1, 2027.

On September 9, 2026, the Department of Consumer Affairs notified the Consumer Protection (E-Commerce) (Amendment) Rules, 2026. The instrument amends the 2020 framework, introducing strict operational mandates for digital marketplaces and inventory-led platforms.

The rules take effect on January 1, 2027, and bind all e-commerce entities operating in India. The amendment expressly prohibits platforms from manipulating search results or search indexes to mislead users. Marketplace entities must distinctly identify sponsored listings with clear and prominent disclosures. To regulate discount claims, any announced price reduction must now be displayed alongside a “prior price”. The rules define this prior price as the lowest price offered for that good or service during the preceding 30 days.

The amendment also mandates integration with the National Consumer Helpline (NCH) convergence process. Grievance officers must acknowledge consumer complaints within 48 hours, provide the complainant with a recorded copy of the grievance, and resolve the issue within one month. Additionally, platforms must conduct an annual self-audit against the 2023 Guidelines for Prevention and Regulation of Dark Patterns and publicly display a Certificate of Compliance.

For an in-house legal team, the January 1 deadline forces immediate cross-functional rework. Legal must coordinate with engineering to adjust search-ranking parameters and ensure sponsored results are distinctly labelled. The pricing display interface requires a backend logic change to track and display the 30-day prior price alongside any discounted rate.

The grievance redressal workflow also requires an update. Legal operations must configure ticketing systems to automatically issue a recorded copy of the complaint to the consumer, while tracking the 48-hour acknowledgement and one-month resolution mandates. Finally, compliance teams must design the framework for the new annual dark-pattern self-audit, establishing review boundaries for user interfaces before issuing the mandatory public certificate.
